General Terms and Conditions of DIALOGMUSEUM gGmbH for Bookings and Voucher Purchases via the Ticket Shop

These “General Terms and Conditions” apply to all transactions between DIALOGMUSEUM gGmbH, Schäfergasse 17, 60313 Frankfurt am Main, Germany, and the customer, which are made via the ticket store of DIALOGMUSEUM gGmbH. Conflicting terms and conditions of the customer shall not apply.

1. conclusion of contract

After the customer has completed the booking of the service via the ticket store of DIALOGMUSEUM gGmbH, he will receive a confirmation e-mail from DIALOGMUSEUM gGmbH, which constitutes the binding acceptance of his booking.

2. scope of services

2.1 Dialogue in the Dark.

The guided tour “Dialogue in the Dark” is designed to experience the non-visual world. Visitors will be loaned a long cane for the blind and will be guided in small groups of no more than 8 people by blind and visually impaired staff through a lightless exhibition parcours of approximately 350 m2 . During a 60-minute tour, visitors experience a walk through several connected, absolutely lightless rooms in which everyday situations, in complete darkness, are realistically depicted.

2.2 Educational Workshops.

The educational workshops are aimed at promoting a more conscious perception through the senses, talking to blind people about blindness and creating an awareness of being different.

3. cancellation

3.1 Pursuant to § 312g para. 2 no. 9 BGB (German Civil Code), the customer has no right of revocation and therefore no right to free cancellation of tickets purchased for a specific date. The ticket price will not be refunded even if the customer, for whatever reason, is unable to attend the event.

4. voucher

4.1 The customer has no right to cash payment of the voucher.

4.2 When purchasing the voucher via the DIALOGMUSEUM gGmbH ticket store, the customer has the right to revoke the contract on the purchase of the voucher within fourteen days without stating any reasons. The revocation period begins on the day on which the customer received the voucher. To exercise his right of revocation, the customer must declare his revocation in writing (e.g. by letter, fax or e-mail) to DIALOGMUSEUM gGmbH: DIALOGMUSEUM gGmbH Schäfergasse 17, 60313 Frankfurt am Main, Fax: +49 (0) 69 – 999 999 529, E-Mail: In order to comply with the revocation period, it is sufficient that the customer sends the notification of the exercise of the right of revocation before the expiration of the revocation period.

4.3 Upon revocation of the contract for the purchase of the voucher, the customer is obliged to return the original voucher to DialogMuseum gGmbH. DIALOGMUSEUM gGmbH shall reimburse the customer for the purchase price of the voucher, including the original shipping costs, without delay and no later than within fourteen days after DIALOGMUSEUM gGmbH has received the customer’s revocation. For the repayment, DialogMuseum gGmbH shall use the same means of payment that the customer used for the original transaction, unless expressly agreed otherwise with the customer. DIALOGMUSEUM gGmbH is entitled to refuse repayment until the customer has returned the original voucher to DIALOGMUSEUM gGmbH. The customer shall bear the costs of returning the voucher. Insofar as the voucher has been redeemed in full or in part and the contract is revoked, the customer is obligated to pay compensation for the value.

5. event cancellation

DIALOGMUSEUM gGmbH reserves the right to cancel events if there are not enough registrations up to 14 days before the event. In the event of cancellation or partial cancellation of individual or all exhibition elements due to force majeure, such as interruption of the power supply, bad weather, vandalism, as well as due to maintenance and repair work, etc., the customer shall not be entitled to a reduction of the admission price.

6 Liability

DIALOGMUSEUM gGmbH is liable without limitation if the cause of damage is due to its own or attributable intent or gross negligence. DIALOGMUSEUM gGmbH is also liable for the slightly negligent breach of obligations that are essential for the performance of the contract (cardinal obligations). In this case, liability is limited to the foreseeable damage typical for the contract. DIALOGMUSEUM gGmbH does not assume any further liability for slight negligence. The above limitations do not apply to injury to health, body and life or in case of fraudulently concealed defects. As far as the liability of DIALOGMUSEUM gGmbH is limited, this also applies to the personal liability of its employees, representatives and/or vicarious agents.

7. valuables

DIALOGMUSEUM gGmbH assumes no liability for valuables, cash, wardrobe or similar items.

8. damage to property

8.1 In case of wilful damage to property of DIALOGMUSEUM gGmbH, such as exhibits or furniture, the customer will be charged the replacement value.

8.2 In the event of soiling that can be proven to have been caused by non-compliance with the instructions of the service personnel, the customer will be charged € 40.00 (incl. VAT) per required working hour of the personnel for cleaning.

9. allergies and intolerances

9.1 Allergies known to the customer cannot be addressed in Dialogue in the Dark.

10. technical equipment

Insofar as DIALOGMUSEUM gGmbH procures technical or other equipment from third parties on behalf of the customer for the performance of the event, DIALOGMUSEUM gGmbH shall act on behalf and for the account of the customer. The customer shall be liable for the careful handling and proper return of such equipment and shall indemnify DIALOGMUSEUM gGmbH against all claims of third parties arising from the provision of the equipment. The customer is not liable for any fault attributable to DIALOGMUSEUM gGmbH.

11. reservation of right to change

11.1 DIALOGMUSEUM gGmbH is entitled to unilaterally amend the General Terms and Conditions, provided that the amendment does not disadvantage the customer and is due to a change in circumstances that DIALOGMUSEUM gGmbH did not foresee, that DIALOGMUSEUM gGmbH did not cause, and that DIALOGMUSEUM gGmbH had no influence on (in particular, changes in the legal situation, supreme court rulings, or market conditions).

11.2 DIALOGMUSEUM gGmbH shall inform the customer about the new GTC. If the customer does not object to the amended GTC within a six-week period, his consent to the validity of the new GTC shall be deemed granted.

Participation implies consent to the recording, storage and publication of image and sound material.

13. final clause

Should individual provisions of these General Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by the valid provision that comes closest to the economic purpose of the invalid provision.
